Samsung Sues Apple in France
Samsung sued Apple in France, putting emphasis on technology patent infringement over design in the latest chapter in the tech giant's legal struggle.

The South Korean manufacturer filed a suit in Paris claiming Apple's iPhones and iPads infringed on three technology patents relating to its Universal Mobile Telecommunications System (UMTS).

"The complaint focuses on three technology patents, and not on the design of the tablets," a Samsung spokeswoman said.

Samsung is likely trying a new tactic with this technology-focused lawsuit, since it has not yet won a design case against its rival Apple.

Apple has been successful in alleging Samsung copied the "look and feel" of its smartphones and tablets when it initially filed suit against Samsung in April.

A German court recently banned Samsung's Galaxy Tab 10.1 and 7.7 from shelves at Apple's request, while a Dutch court did the same with several Samsung smartphones.

In addition, Samsung agreed to stop selling its Galaxy Tab 10.1 in Australia while a court decides whether the South Korean company violated its Cupertino, Calif.-based rival's iPad design.

Apple also filed injunctions against Samsung's devices in the U.S., South Korea and recently in Japan, all alleging design infringement.

Samsung filed countersuits against Apple in the U.S., South Korea, Australia and the Netherlands but has yet to see a victory in any of these countries. The electronics maker likely hopes its new technology patent-focused infringement lawsuit in France will put it on stronger legal ground and take away scrutiny of its design. A Samsung win on technology may offer the company an opening for its evolving strategy against Apple in court.

The case, originally filed in July, is set for a December hearing.
